While media focus and debate ensues over plastic baby bottles, a new story adds a sudden and unexpected twist. Totaling near NIS 90 million, 2 class action lawsuits have been filed against Philips Avent, sellers of Avent baby bottles, as well as Super-Pharm, the marketers of the Life bottle brand.
The companies are accused of hiding the fact that BPA found in the plastic baby bottles could possibly leach into baby drinks or food in certain situations and for not advising consumers about the safety precautions. The lawsuits follow the Health Ministry’s safety guidelines regarding the use of plastic baby bottles just 2 weeks ago.
The plaintiffs argue that the Ministry’s safety guidelines are not new, but rather a re-statement of the 2006 issued advice. Also requested in the lawsuits is a mandatory change in product packaging for both companies that entails user instructions to adequately inform consumers. A similar lawsuit has been filed earlier this month in the US District Court for Western Missouri alleging the companies did not disclose known health effects of BPA.
Could lawsuits set a new precedent for baby bottle safety? That is yet to be seen, but may be unlikely in the United States as the US Food and Drug Administration (FDA) defends BPA safety in baby bottles. The FDA stated last week there is no real reason to stop using plastic bottles, including baby bottles, which contain BPA. An FDA spokesperson said a “large body of available evidence” shows that products made with BPA are safe, although confesses that they are reviewing safety concerns.
Also being defended is the FDA’s reliance on 2 plastic industry funded studies finding BPA is safe, despite the fact that several other studies found BPA to pose several serious health risks in lab animals. Senators are claiming both the Product Safety Commission and the FDA are failing to protect American consumers not just from BPA, but phthalates as well. Democratic Sen John Kerry goes on to say “the FDA could hardly be doing less”. Kerry along with several other democrats proposed a bill in April to ban BPA in children’s products and to increase studies on the health effects of BPA.
